Before we talk

What helps to have handy

You don’t need paperwork to start. The 9 questions only ask for rough figures, take about a minute and don’t involve a credit check.

When we call, a few documents make it quicker to work out which options are realistic. We work on Sydney time, which is 2 or 3 hours ahead of Perth. If a call comes at a bad time, tell us when suits you better.

Handy for the call
A list of your debts and who they’re owed to
Recent statements, if you have them
What comes in each week or fortnight
Regular costs such as rent, bills and groceries
Any letters from creditors or the ATO
Rough figures are fine to start with.
Your options

Start with what you want to happen

Each option suits a different goal, and each has trade-offs.

One repayment instead of several
Debt consolidation: a new loan pays out several debts. We look at lenders on our panel.
Good to know: lending criteria apply and some applications are declined. Applying records a credit enquiry, a longer term can cost more overall, and a loan secured on your home puts the home at risk.

More time, without a formal option
Informal arrangements: we negotiate new repayment terms with each creditor.
Good to know: creditors don’t have to agree, interest may keep running, and it may show on your credit report.

A binding plan to repay what you can afford
Debt agreements (Part IX): a formal agreement with your creditors. We’re an AFSA-registered administrator.
Good to know: it’s an act of bankruptcy, and debt, asset and income limits apply.

Learn more →

A formal agreement for higher debts or income
Personal insolvency agreements: a Part X agreement run by a registered trustee.
Good to know: it’s an act of bankruptcy and can stop you managing a company.

A listing on your credit file looks wrong
Credit file corrections: we review the listing and ask for a correction where there are grounds to.
Good to know: correct listings can’t be removed, and some requests are refused.

Understand bankruptcy before deciding
Bankruptcy information: how it works and how it compares. We aren’t a trustee.
Good to know: it usually lasts 3 years and 1 day and can affect your assets, income, travel and work.

Deal with the business’s ATO debt
Business & ATO debt: payment arrangements, director penalty notices and small business restructuring with a registered practitioner.
Good to know: the options depend on how the business is set up, and a director penalty notice has a 21-day window.

Downsides worth knowing

Before taking out a loan
Lending criteria apply, and some applications are declined
Applying records a credit enquiry on your credit file
A longer term can cost more overall, even if each repayment is smaller
A loan secured on your home puts your home at risk if repayments are missed

Before a formal option
Proposing a debt agreement or a personal insolvency agreement is an act of bankruptcy
Formal options go on your credit report, usually for up to 5 years, or longer in some cases
A debt agreement stays on the National Personal Insolvency Index for 5 years from when it’s made, or until it’s completed if that’s later
Personal insolvency agreements and bankruptcy stay on the index permanently
What it costs

Debt Negotiators is a fee-based service. Fees are explained before you decide, and the first conversation costs nothing. If you take out a loan we arrange, we may receive a commission from the lender. We’ll tell you about it before you decide. The rates are in our Credit Guide.

Referrals and payments: We work with a panel of registered trustees and a panel of registered small business restructuring practitioners. If we refer you to one, we may receive a referral payment, and we may charge fees for pre-insolvency work. We’ll tell you about any payment or fee before you decide.

Perth debt help questions

Do you have an office in Perth?

No. We don’t have an office in Perth or anywhere in Western Australia. Our team is based in Bankstown, NSW, and works with people in Perth by phone, as we do in Sydney, Melbourne, Brisbane and Adelaide. If you’d prefer to meet face to face, you can make an appointment at our Bankstown office.

Perth is behind Sydney. When will you call?

Perth doesn’t use daylight saving, so it’s 2 hours behind Sydney from April to October and 3 hours behind from October to April. We call Monday to Friday, 9am to 5pm Sydney time. If our call clashes with work or family time, tell us when suits you better.

Does WA have its own debt agreement rules?

No. Debt agreements, personal insolvency agreements and bankruptcy all come under the Bankruptcy Act 1966, a Commonwealth law. They work the same way in Western Australia as in the rest of the country.

Will my creditors find out?

It depends on the option. For an informal arrangement, we contact each creditor on your behalf. A debt agreement proposal goes to your creditors to vote on. A consolidation loan pays out your existing creditors. We’ll explain who is contacted before you decide.

Can you look at a listing on my credit file?

Yes. If a listing looks wrong, we review it and ask the credit provider for a correction where there are grounds to. Correct listings can’t be removed, and we’ll tell you plainly if a listing looks accurate.

Do I have to go ahead after the call?

No. You hear your options, what each one costs and its downsides, and then you decide. There’s no obligation.
