How it works

Three steps, all by phone

1

Answer 9 quick questions
It takes about a minute online and doesn’t involve a credit check. Rough figures are fine. Start here.
2

We call you Monday to Friday, 9am to 5pm Sydney time
A member of our Bankstown team goes through your answers. If the time doesn’t suit, tell us when does.
3

You hear your options, then decide
We cover what each option would mean for you, its cost and its downsides, and say plainly if one doesn’t suit.
What it costs

Debt Negotiators is a fee-based service. Fees are explained before you decide, and the first conversation costs nothing. If you take out a loan we arrange, we may receive a commission from the lender. We’ll tell you about it before you decide. The rates are in our Credit Guide.

Referrals and payments: We work with a panel of registered trustees and a panel of registered small business restructuring practitioners. If we refer you to one, we may receive a referral payment, and we may charge fees for pre-insolvency work. We’ll tell you about any payment or fee before you decide.

Not formal insolvency

Starting with the less formal options

These options aren’t recorded on the National Personal Insolvency Index. They still have trade-offs.

Informal arrangements
We contact each creditor on your behalf and ask for terms that fit your budget, such as more time or smaller instalments.
Good to know: creditors don’t have to agree, interest may keep running, and it may show on your credit report.

Debt consolidation
Your existing debts are paid out by a single new loan from a lender on our panel, leaving one repayment to manage.
Good to know: not everyone is approved, because lending criteria apply. Each application leaves a credit enquiry on your file, spreading the debt over longer can cost more in total, and if the loan is secured on your home, the home is at risk.

Credit file corrections
We check listings you think are wrong against the reporting rules, and request a correction where the evidence supports one.
Good to know: correct listings can’t be removed, and some requests are refused.

Formal options

Options under the Bankruptcy Act

These are national law, so they work the same way in Queensland as anywhere in Australia. Each one is recorded on the National Personal Insolvency Index and your credit report.

Debt agreements (Part IX)
You offer your creditors an affordable amount over a set period, and once accepted it binds them. We act as the AFSA-registered administrator.
Good to know: it’s an act of bankruptcy, and debt, asset and income limits apply. It stays on the index for 5 years from when it’s made, or until it’s completed if that’s later.

Learn more →

Personal insolvency agreements
Used when debts, assets or income are too high for a debt agreement. A registered trustee runs it under Part X.
Good to know: it’s an act of bankruptcy, it stays on the index permanently, and it can stop you managing a company.

Bankruptcy information
If you’re weighing up bankruptcy, we set out what it would mean for you next to the alternatives. We aren’t a trustee.
Good to know: it usually lasts 3 years and 1 day, can affect your assets, income, travel and work, and stays on the index permanently.

On your credit report, formal options usually stay for up to 5 years, or longer in some cases. Compare every option on our debt solutions page.
For business owners

Business and ATO debt

If you run a business, as a sole trader or through a company, ATO debt has its own set of options. We look at payment arrangements with the ATO, director penalty notices, and small business restructuring with a registered practitioner.

If you have personal debts too, we look at both on the same call.

Good to know
The options depend on how the business is set up and what’s owed
A director penalty notice has a 21-day window
Small business restructuring is only open to companies that meet set criteria

Brisbane debt help questions

Is there a Debt Negotiators office in Brisbane?

No. We don’t have an office in Brisbane or anywhere in Queensland. Our team is based in Bankstown, NSW, and works with people in Brisbane by phone, the same way we do in Sydney, Melbourne, Perth and Adelaide. If you’d prefer to meet face to face, you can make an appointment at our Bankstown office.

What time will you call me in Brisbane?

We call Monday to Friday, 9am to 5pm Sydney time. Queensland doesn’t use daylight saving, so from October to April Brisbane is an hour behind Sydney. For the rest of the year, it’s the same time. If the time we call doesn’t suit, tell us when does.

Can you help if my creditors are based in another state?

Yes. The options we work with aren’t limited by state. An informal arrangement is negotiated with each creditor wherever they’re based, and a debt agreement can cover unsecured creditors anywhere in Australia.

Is bankruptcy the only option if I can't keep up?

Not usually. An informal arrangement, a debt agreement or a personal insolvency agreement may be worth comparing first. Bankruptcy has serious, long-lasting consequences, and we explain how it compares before you decide.

Can you help with business tax debt as well as personal debt?

Yes. Sole traders and company directors often have both, and we go through them together on the same call.

I've been declined for a loan. What now?

It doesn’t rule out other options. An informal arrangement or a debt agreement doesn’t depend on lending criteria, though each has its own downsides and limits. Several declined applications in a short time can make the next one harder, so talk it through before applying again.

What does it cost?

Debt Negotiators is a fee-based service. Fees depend on the option and the work involved, and they’re explained before you decide. The first conversation costs nothing.
